Terms and Conditions
By booking any Qigong training course (consisting of 12 weekly classes) you agree to the terms and conditions below. Please get in touch if you are unclear of any of the provisions.
In consideration of the mutual covenants and agreements contained herein, the above mentioned parties agree as follows:
1. Outline of agreement
1.1 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, agrees to provide the Qigong Training Course that you have chosen.
1.2 The course will include the use of Shaolin Cosmos Qigong.
1.3 You agree to be bound by the terms of this agreement.
2. Payment
2.1 In exchange for the service, you agree to pay the fee in advance, or any agreed discounted promotional fee, if applicable.
2.2 You are responsible for the total fee as stated in clause 2.1 of this agreement, regardless of whether or not you attend all the sessions.
2.3 You authorise Energy Alchemy Ltd to process payment by way of credit card, bank transfer, cash, or to initiate payment by PayPal, Sumup, Stripe, GoCardless.
2.4 Payment plans may be arranged at the discretion of Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd. If we agree to payment for our services by payment plan, a supplementary fee may be charged.
3. Cancellation/amendments
3.1 If you wish to cancel your course, you can do this by emailing us at [email protected].
3.2 If you cancel at least 14 days before the course, you will be given the option to reschedule your course or to receive a refund. If we have incurred any reasonable costs, the money already paid may not be refundable.
3.3 If you cancel with less than 14 days notice, any money you have paid may not be refundable.
3.4 The classes in your training course are scheduled for fixed dates and times and it is your responsibility to ensure you attend on time.
3.5 If you fail to attend a class then you will forfeit that session and will not be entitled to a refund or to reschedule.
3.6 All classes in your course are scheduled for 1 hour. It is important that you arrive on time for your class as you will not receive the full time allocated if you are late for the class.
3.8 If due to exceptional circumstances your instructor needs to cancel a class, you will be notified as soon as possible and an alternative date will be provided. If you are unable to attend any of the alternative dates provided then you will be entitled to a refund.
4. Results and guarantees
4.1 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, does not guarantee any results or make any health claims.
4.2 Although Qigong has great benefits, results are dependent on a number of factors including, but not limited to your commitment to the course and your own training when out of the class environment, participation and existing health conditions.
4.3 Testimonials and examples provided are not intended to represent or guarantee that you will achieve the same or similar results.
4.4 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, does not provide medical, legal, investment or business advice. All opinions are provided for your consideration and should not be solely relied upon. It is your responsibility to obtain professional advice.
5. Health
5.1 In order to experience the full benefits of the course/class, it is advisable not to drink alcohol or consume any illegal drugs for at least 48 hours before the start of any class.
5.2 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, does not claim to heal, treat or cure any health conditions and you must continue to take any prescribed medication throughout the entire duration of the course.
5.3 You must not consume any alcohol or illegal drugs at any time during the course.
5.4 Clothing must be worn at all times during classes.
5.5 In order to provide the best environment to learn Qigong, the instructor may be required to place their hands on appropriate parts of the body, for example to correct posture. The instructor will advise you prior to any touch or contact. If you are not comfortable with this then you must advise the instructor prior to the start of the class.
5.6 The exercises included as part of your course/class may involve the use of gentle breathing or physical movement.
5.7 It is your responsibility to advise the practitioner prior to the start of any course/class of any injuries or health conditions you have which may impact on your ability to participate in the course/class.
6. Reasonable use of equipment
6.1 During the session we may use equipment which requires specific handling and you must take reasonable care at all times during the session to ensure your safety.
6.2 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, will not be liable for any injury or loss which is caused by your negligence.
7. Force majeure
7.1 If, as a result of an act of God, force majeure, public emergency, restriction imposed by law or for any other cause beyond our reasonable control, we are unable to provide services to you, we shall not be in breach of this agreement but shall be authorised to substitute a reasonably satisfactory date and time to provide services.
7.2 If no such time is available, the remainder of the fees due for any service(s) that have not yet been provided will be waived.
7.3 We shall not be liable for inability to provide services or fulfil the agreement in those circumstances.
8. Termination
8.1 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, reserves the right to terminate this agreement at any point if we feel that you are being disruptive, are acting in breach of the law, or are in violation of this agreement. All fees will become payable by you upon termination of this agreement.
9. Confidentiality
9.1 Confidential information refers to any data or information relating to you, whether business or personal:
– which would reasonably be considered to be private or proprietary to you;
– that is not generally known, and;
– where the release of that confidential information could reasonably be expected to cause harm to you.
9.2 Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, agrees that we will not disclose, divulge, reveal, report or use, for any purpose, any confidential information which we have obtained, except as authorised by you or as required by law. The obligations of confidentiality will apply for the duration of the session and will survive indefinitely upon termination of this agreement.
9.3 All written and oral information and material disclosed or provided by you to us under this agreement is confidential information regardless of whether it was provided before or after the date of this agreement or how it was provided to us.
10. Complaints
10.1 We are committed to providing the best service possible. If for any reason you are not satisfied with the service, please contact us at [email protected].
10.2 We will look into your complaint and where you have a genuine concern, we will endeavour to resolve the issue.
11. Governing law
11.1 This Agreement shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
12. Entire agreement
12.1 This Agreement is the entire agreement and understanding between Shaolin Qigong Hampshire, trading as Energy Alchemy Ltd, and you and supersedes any prior agreement or understanding whether oral or written relating to this Agreement.
